Dear Michael,
I refer to the
e-mail you sent to Sarah on Wednesday, which sought approval for out of hours
working in respect of the Newhaven Port Access Road (planning application ref:
LW/2565/CC). I am responding to this request as Sarah is on leave this week.
I have given due
consideration to your request and taken into account the nature of the works
proposed and the potential impact of the works on the amenity of the local
community. Whilst these works are proposed to be carried out during what are
considered to be particularly unsociable hours, this has to be balanced against
the necessity to undertake the works during railway possessions (in respect of
the works proposed between the 10 and 15 August) and when traffic levels are
light (in respect of the works between the 17 and 29 August). Consequently, in
accordance with the powers delegated to me and pursuant to the provisions
within Condition 17 of the above planning permission, I hereby APPROVE the
additional hours of working as set out in your email of the 5 August.
This is on the basis that the works are undertaken in accordance with the
details set out in your aforementioned e-mail, and in particular the mitigation
measures proposed.
Please note that if
at any time the activities being carried out in these extended hours give rise
to justifiable complaint, or demonstrable harm to amenity, I reserve the right
to withdraw this temporary amendment to the permitted working hours. Please
also note that should you receive any complaints, you should notify the County
Planning Authority within two working days of receiving the complaint.

Planning Act 1990 relating to Newhaven Port Access Road, reference LW/2565/CC –
Condition 17
We are writing to
request out of hours working in relation to the Newhaven Port Access Road
Project. The out of hours working relates to the following works:-
We are planning our works in consultation with Network
Rail during the following times:-
The painting remedial
works are required following the removal of the temporary shutters over the
railway. The works will involve cleaning the girders and applying the 3 coat
paint system to the beams where some minor damage has been sustained. All
access to the beams will be from a mobile elevated platform from the newly
constructed bridge deck.
The works are
required during a night time railway possession so that the required
construction plant can carry out operations safely and to prevent any risks to
the operational railway.
To minimise impact on
the local community we propose the following mitigation:
The main plant and
equipment planned for the works are:
There are 9 No.
planned personnel for the works:
The works will be
accessed from our south compound currently located within Newhaven Port and
within our current site footprint of the Newhaven Port Access Road Scheme.
2. Kerb
realignment works Mckinley Way, Drove Retail Park.
We are planning our
works in consultation with ESCC Highway’s team.
As part of our works for the Newhaven PAR
project we are required to carry out some minor kerb amendments and relocate
the existing tactile crossing (see attached drawing
6000032-WSP-HKF-NPAR-DR-CH-0003) to the entrance of the Drove Retail Park of
off Mckinley Way. The entrance is shown below.
Due to the location and volume of traffic
using the retail park during normal working hours we intend to complete these
works between 20.00hrs – 06.00hrs using Traffic management priority boards over
a period of two weeks when minimal traffic is entering the retail park.
The works are
required during off peak and night time periods so that the required
construction plant can carry out operations safely and to prevent any traffic
delays during the normal working hours for the retail park.
To minimise impact on
the local community we propose the following mitigation:

equipment planned for the works are:
There are 6 No.
planned personnel for the works:
The works will be
accessed from our North compound currently located at the end of Mckinley Way and
within our current site footprint of the Newhaven Port Access Road Scheme.
In order to keep the
public advised of our works an advance memo will be placed on our information
boards positioned around the works explaining the works, with contact details
of the site team should further questions arise from the general public regarding
the works.
This application is
made on behalf of the Assistant Director, Operations, East Sussex County
Council and the relevant cost code for payment of fees due is C.5.13.067.2.
We trust that our
